CamPow Terms of Use
Welcome to CamPow. These Terms of Use ("Terms") are an agreement between you and [CamPow Entity Name] ("CamPow," "we," "us") and govern your use of the CamPow application, website, and related services (together, the "Service"). By installing or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. What CamPow is (and isn't)
CamPow is a guide to live public webcams. We organize publicly available camera feeds — snow cams, road cams, and similar — into a channel guide so you can tune to them on your TV or other device.
Here is what's important to understand about how that works:
- We don't host the video. When you tune to a camera, your device connects directly to the camera owner's servers and loads the same public stream the owner publishes on their own website. CamPow never carries, copies, stores, or re-transmits any camera stream.
- We don't own the cameras or their content. Every camera belongs to a third party (a resort, a transportation agency, a town, a business, or an individual). Their name is shown whenever you tune in.
- We don't record. The Service has no recording, replay, rewind, clip, or download features, and we keep no archive. A short playback buffer of no more than [30] seconds is held in memory on your device only to keep video smooth; it is discarded when you change channels or leave the app.
- We don't control what a camera shows, whether it's online, or what quality it is. Cameras go down, get moved, freeze, or change without notice.
- We credit the owner. Each camera's owner is shown in the guide, on screen when you tune in, and anytime from the channel's info panel.
2. Third-party content
All camera feeds are Third-Party Content. Each feed is provided by its owner under that owner's own terms, and your access to it through the Service is subject to those terms in addition to these. CamPow makes no claim of ownership over any feed and displays each one as its owner publishes it, with attribution.
When your device loads a feed, the camera owner (and any video vendor the owner uses) receives your device's connection information — typically your IP address and device type — exactly as if you had visited their website. See our Privacy Policy for details.
Camera owners may ask us to stop listing a camera at any time, and we honor those requests. See our Camera Owner Policy.
3. Your license to use the Service
Subject to these Terms, CamPow grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, for personal, non-commercial viewing. CamPow's guide, app, design, name, logo, and software are owned by CamPow and its licensors and are protected by intellectual-property laws. The camera feeds are not licensed to you by CamPow; any rights in them come from their owners.
4. Acceptable use
You agree not to:
- Record, capture, download, scrape, archive, or redistribute any camera feed accessed through the Service, or use the Service to do so;
- Use the Service, or any feed accessed through it, for commercial purposes, public display in a commercial venue, or resale, without the camera owner's permission;
- Circumvent, disable, or interfere with any access control, rate limit, or technical measure of CamPow or of any camera owner;
- Reverse engineer, extract, or reuse CamPow's guide data, camera list, or software except as permitted by law;
- Use the Service to monitor, track, identify, or surveil any person, vehicle, or property;
- Use the Service in any way that is unlawful, harmful, or infringes anyone's rights;
- Overload or disrupt the Service or any camera owner's servers, including by automated access.
We may suspend or terminate access for violations.
5. Availability, changes, and termination
The Service and any camera may be unavailable, changed, or removed at any time, for any reason, including at a camera owner's request. We may modify or discontinue the Service or any feature without notice. You may stop using the Service at any time by uninstalling it.
6. Feedback and reports
If you believe a camera listed on CamPow shows something it shouldn't, or you are a camera owner who wants a camera removed, please use the Exclusion Request page or contact us at [support@campow.tv]. Any feedback you send us may be used without obligation to you.
7. Copyright complaints
CamPow respects intellectual-property rights. Notices of claimed infringement, counter-notices, and our repeat-infringer policy are handled under our Copyright Policy, which also lists our designated agent under the Digital Millennium Copyright Act. Camera owners who simply want a camera removed from the guide can use the Exclusion Request page, which requires no legal notice and is usually faster.
8. Disclaimers
THE SERVICE AND ALL THIRD-PARTY CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. CAMPOW DOES NOT WARRANT THAT ANY CAMERA IS LIVE, CURRENT, ACCURATE, OR SAFE TO RELY ON.
Do not rely on any camera for safety, travel, or emergency decisions. Road and mountain conditions change faster than cameras update. Consult official sources.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPOW AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY THIRD-PARTY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. CAMPOW'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID CAMPOW IN THE TWELVE MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions do not allow these limitations, so they may not apply to you.
10. Indemnity
You agree to indemnify and hold CamPow harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service or any Third-Party Content.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in [County], California, and you consent to their jurisdiction. Nothing in these Terms limits any rights you have under consumer-protection laws that cannot be waived.
12. Changes to these Terms
We may update these Terms. We'll post the new version with a new "Last updated" date, and material changes will be noted in the app. Continued use after changes means you accept them.
